These Terms & Conditions apply to the use of the Smartbooks Education website and the purchase and use of digital educational resources from Smartbooks Education.
By purchasing a resource from this website, you agree to these Terms & Conditions. Please read them carefully before making a purchase.

Smartbooks Education provides downloadable educational resources specialising in Digital Functional Skills materials.

2. Our Digital Resources
Products sold through the Smartbooks Education website are digital educational resources unless otherwise stated.

No physical product will be posted or delivered unless explicitly stated on the relevant product page.
3. Ordering and Payment
Prices are displayed on the website in pounds sterling (£).
Payment must be successfully completed before access to a purchased digital resource is provided.
An order is accepted when payment has been successfully processed and confirmation of the purchase is provided.
We reserve the right to correct obvious pricing or product-description errors. If an error affects an order already placed, we will contact the customer and provide an appropriate resolution.
4. Delivery of Digital Resources
Smartbooks Education resources are supplied electronically.
Following successful payment, customers will normally receive access to their purchased digital resource through the website and/or a download link sent to the email address provided during checkout.
Download links are normally available for 30 days from the date of purchase. Customers are advised to download and securely save their purchased resources during this period. If a download link expires, please contact Smartbooks Education and we will provide reasonable assistance in restoring access to a valid purchase.
Customers are responsible for providing an accurate email address when placing an order.

5. Licence to Use Smartbooks Education Resources
Purchasing a Smartbooks Education resource gives the purchaser a licence to use that resource for educational purposes. Ownership of the copyright and intellectual property does not transfer to the purchaser.
Unless a product description or separate licence states otherwise, resources may be:
• Downloaded and stored by the purchaser.
• Printed or reproduced for use with learners taught or supported by the purchaser.
• Used within the purchaser's own teaching, training or educational delivery.

Resources must not be:

• Shared publicly online or made freely available for download.
• Passed to another organisation or unrelated third party as a substitute for purchasing their own copy.
• Presented, published or sold as the purchaser's own work.
• Modified for the purpose of resale or redistribution.
6. Copyright and Intellectual Property
Unless otherwise stated, the content and design of Smartbooks Education resources are protected by copyright and other applicable intellectual property rights.
Purchase of a resource provides permission to use the resource in accordance with the licence described above. It does not transfer ownership of the underlying intellectual property.
The Smartbooks Education name, branding, original workbook content, activities and associated materials may not be reproduced or commercially exploited except as permitted by these Terms & Conditions or with prior written permission.
7. Editable Resources
Where an editable version of a resource is supplied or made available, the purchaser may adapt that resource for their own permitted educational use.
Editing a resource does not transfer copyright or ownership of the original Smartbooks Education material.
Edited versions remain subject to the restrictions on resale, redistribution, public sharing and commercial reproduction contained within these Terms & Conditions.
8. Digital Downloads and Cancellation
Digital resources are supplied electronically and may be made available for download immediately following successful payment.
Where required by law, before immediate supply begins, customers will be asked to expressly consent to the digital content being supplied immediately and to acknowledge the effect this has on their statutory right to cancel.
Nothing in these Terms & Conditions affects any statutory rights that cannot legally be excluded.
9. Faulty or Incorrect Digital Content
We take reasonable care to ensure that Smartbooks Education resources are accurately described and supplied correctly.
If a resource is faulty, corrupted, materially different from its description or the wrong resource has been supplied, please contact us at smartbooksed@outlook.com so that we can investigate and provide an appropriate remedy.
Nothing in these Terms & Conditions limits your statutory rights in relation to digital content.

11. Educational and Qualification Information
Smartbooks Education resources are designed to support teaching and learning relating to Digital Functional Skills.

Teachers, tutors, training providers and other users remain responsible for determining whether a resource is appropriate for their learners, curriculum, awarding organisation requirements and individual teaching circumstances.
